Terms & Conditions

Radiolize(we, us, our) at https://radiolize.com (provider), delivers radio station hosting, setup and management services of online streaming service and related digital services.

Radiolize reserves the right to make alterations to this document whenever we deem reasonable. It is the client’s sole responsibility to check this document for updates on a regular basis.

All material on this site, including but not limited to text, images, illustrations, code, scripts and audio clips/live audio is protected by copyrights which are owned and controlled by Radiolize. Material from this website may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, unless we give you the written permission to do so.

Do not misuse our Services, for example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and control laws and regulations. You may not use our services to distribute illegal or un-sociable material. If you are breaking laws, being obscene, spreading false information, or abusing our infrastructure, we have the right to stop you from doing these things. Failure to comply will result in Radiolize terminating your account with immediate effect. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content that you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure or alter any legal notices displayed in or along with our Services.

Our Services display some content from third parties. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please do not assume that we do.

In connection with your use of the Services we may send you service announcements, administrative messages and other information. You may opt out of some of those communications.

Users are in charge of their own platforms. Radiolize is not liable or responsible for users’ actions. All liability and responsibilities including song licenses, products or data and content belongs to the station owner.

API resources for Radiolize products are shared with other users of the system and clients are required to understand this. We reserve the right to monitor, restrict, suspend API access or bill clients found to be using a disproportionate level of shared resources on a regular basis.

We do not provide any form of legal cover to any individual or company who utilize our services to distribute content with any copyright protection. Under no circumstances will Radiolize be responsible for the behaviour of our clients or their users when found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities.

Radiolize does not provide any form of music licensing or coverage for royalties. We recommend always consulting with qualified professionals or the relevant authorities for your country regarding copyright and licensing.

If contacted by an authority in the event of an illegal situation regarding the distribution of adult, racist or any other un-sociable material, we will co-operate fully in any investigations they decide to make against clients found to be breaking the law.

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Fair Use & Overages

All clients are subject to a fair use policy to maintain network health for all users. If we detect excessive use of our API or streaming servers for an extended period of time, we may enforce rate limiting or shut station for a while. A member of the team will contact your station owner if this occurs.

Without exception, Radiolize requires prior notification from clients who intend to use Radiolize’s services in conjunction with any large events and/or product launches. Sudden increase or spikes in traffic due to events or launches may cause interruption to service. If Radiolize is not informed prior to the fact, we will not be held liable for any interruption in your service during this time.

All plans include concurrent listener limits. Radiolize may pause your station and notify you about fair use if your station exceeds abrupt bandwidth usage.

Payments

Except in unusual circumstances such as service interruption for more than 48 hours, incorrect billing, all payments billed to existing clients are non-refundable. Users wishing to cancel their service should do so via the My Account section of their Radiolize account at least 2 days before their next billing date, or within their 7 day trial period.

Our base pricing is laid out in Euros (€) for your convenience and subject to change depending on current exchange rates. Canceling a subscription directly without notifying us may result in an automated termination of service and loss of data.

You are not liable for any form of refund if you have breached the terms of service in any way.

Mobile Apps (Android & iOS)

We cannot guarantee all models of device will support Radiolize Mobile Apps. They have been designed to work on most newer devices including iOS 10 or above, and Android 7.0 or above.

We are unable to update existing Apps on Google Play if they were developed by a third party. All new Android Apps will be provided with intent to publish as a new App. In similar cases with iOS Apps the support team may contact you to confirm.

Due to recent security changes, your iOS App may be rejected due to access issues. You will be asked to contact support via live chat to resolve.

Mobile Apps are reviewed by the in-house development team to ensure they are suitable for the store. Images which are deemed explicit or breach copyright will be rejected. Review may filter or amend text that is deemed unsuitable for store listings.

We do not accept any liability for third party applications which violate Apple/Google Play Terms of Service and/or Apple/Google Play Developer Program Policies. By purchasing and using Radiolize Mobile Apps you are agreeing that you have read and understood the guidelines for any services where you intend to publish your App. For all intents and purposes, and unless otherwise stated in writing by Radiolize, all applications developed by us are considered third party applications.

Once any App has been developed, Radiolize is not responsible for any delays caused by the publishing or review process and is not liable to compensate for any such delays. Mobile Apps are chargeable regardless of their status on any third party app marketplace.

We reserve the right to promote Radiolize within the App interface.

Live Chat

Live chat is designed for quick questions and sales queries only. If a client requires support they should use the official methods stated above. Our sales chat operators will not tolerate abuse or profanity. If used we reserve the right to evaluate the status of your services with us (if applicable) which could result in account suspension.

Your Content in our Services

Some of our Services allow you to upload, submit, store, send or receive content You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload, submit, store, send or receive content to or through our Services, you give Radiolize (and those we work with) a worldwide licence to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes that we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this licence are for the limited purpose of operating, promoting and improving our Services, and to develop new ones. Some Services may offer you ways to access and remove content that has been provided to that Service. Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure that you have the necessary rights to grant us this licence for any content that you submit to our Services.

About Software in our Services

When a Service requires or includes downloadable software, this software may be updated automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

You may not reverse engineer or attempt to extract the source code of our website and software, unless laws prohibit those restrictions or you have our written permission.

Open-source software is important to us. Some software used in our Services may be offered under an open-source licence that we will make available to you. There may be provisions in the open-source licence that expressly override some of these terms.

Modifying and Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features and we may suspend or stop a Service altogether.

You can stop using our Services at any time, although we would be sorry to see you go. Radiolize may also stop providing Services to you or add or create new limits to our Services at any time.

We believe that you own your data, and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that Service.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we do not promise about our Services.

Other than as expressly set out in these terms or additional terms, neither Radiolize nor its suppliers or distributors make any specific promises about the Services. For example, we do not make any commitments about the content within the Services, the specific functions of the Services or their reliability, availability or ability to meet your needs. We provide the Services “as is”.

Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.

Liability for our Services

When permitted by law, Radiolize and Radiolize’s suppliers and distributors will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages.

To the extent permitted by law, the total liability of Radiolize and its suppliers and distributors for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use the Services (or, if we choose, to supplying you with the Services again).

In all cases, Radiolize and its suppliers and distributors will not be liable for any loss or damage that is not reasonably foreseeable.

We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumers’ legal rights which may not be waived by contract.

About these Terms

We may modify these terms or any service specific terms, for example, to reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

If there is any inconsistency between these terms and the additional terms, the additional terms will prevail to the extent of the inconsistency.

Any charges laid out in these terms are presented in US Dollars ($). If your subscription is billed in any other currency we will use the current day’s exchange rate to process any charges due.

These terms govern the relationship between Radiolize and you. They do not create any third party beneficiary rights.

If you do not comply with these terms and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

Radiolize Respects Your Privacy

This Policy explains when and why we collect personal information about people who visit our website or web application, how we use it, the conditions under which we may disclose it to others and how we keep it secure.

We may change this Policy from time to time so please check this page occasionally to ensure that you’re happy with any changes. By using our website or web application, you’re agreeing to be bound by this Policy.

What Personal Data Do We Collect?

Personal Data You Provide to Us Voluntarily – We collect information about you that you voluntarily provide to us when you: (i) contact us to learn more about Radiolize, Subscribe to a mailing list or other opportunities you indicate are of interest at the time; (ii) access or use Radiolize’s Services (my.radiolize.com); or (iii) contact customer service. This information may include, for example, your name, business name, and any other information that you choose to provide to us when you comment on materials on our Radiolize Services, in order to contact you as a potential customer, or respond to a support request. This also includes technical data, such as IP addresses and device identifiers that are commonly generated in establishing a connection with the Radiolize Services. Payment information collected is processed securely by our Payment processor and is not stored in Radiolize’s databases. This is bound by our processors privacy policy and will not be passed on to third parties under any circumstances.

Other Data – By using the Radiolize services we may store information about what pages have been visited and when. This is to help us improve the usability of our services.

Retention – We collect and retain Personal Data submitted to Radiolize in an identifiable format for the amount of time necessary to meet your request or fulfil our legal or regulatory obligations, unless it is in our legitimate business interests and not prohibited by law to maintain the Personal Data for longer periods.

How Do We Process Personal Data?

We may use information for our legitimate interests, namely:

  • To operate the Radiolize Services.
  • To contact and communicate with you when you reach out to us to ask us about our Radiolize Services.
  • To manage everyday business needs.
  • To analyze or improve the Radiolize Services or additional products or services.
  • To protect the Radiolize Services and the rights of Users and others to enforce the terms of the Radiolize Services.
  • To comply with our obligations, including to comply with all applicable laws and regulations.
  • To send you promotional materials from us or on behalf of our affiliates and business partners if you have consented to the receipt of such materials.

Who Has Access to Your Information?

Under no circumstances will we directly disclose or sell your personal information to any third party without your prior permission. We are strongly against any form of internet ‘spam’ and keep all collected information strictly confidential in accordance with the General Data Protection Regulations (GDPR).

We will not sell or provide your information to third parties for marketing purposes.

Third Party Services Working on Our Behalf

We may pass your information to our third party service providers, or other associated organisations for the purposes of completing tasks and providing services to you on our behalf (for example processing payments and providing sales/technical support). However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes.

Please be reassured that we will not release your information to third parties beyond the Radiolize network for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

When you are using our secure online payment system, your payment is processed by a third party processor, who specialises in the secure online capture and processing of credit/debit card and PayPal transactions. If you have any questions regarding secure transactions, please contact us.

Radiolize’s infrastructure is managed by multiple service providers. However they do not have access to any personal information and are prohibited to selling or passing on any stored data.

Security and Your Data

We take data security very seriously. Our databases are backed up regularly, and any data collected from you is sent over an encrypted SSL secure connection. Security of our data is important to us and we take every possible reasonable measure to prevent against loss, damage, theft or misuse where possible.

Any data processed by one of the third parties working on our behalf is also sent over an encrypted SSL connection. Third parties are contracted to provide a high level of security on their systems.

Use of Cookies

Like many other websites, the Radiolize website uses cookies. ‘Cookies’ are small pieces of information sent by an organisation to your computer and stored on your hard drive to allow that website to recognize you when you visit. They collect statistical data about your browsing actions and patterns and do not identify you as an individual. For example, we use cookies to store your login preferences. This helps us to improve our website and deliver a better more personalized service.

Website Recording

Our web application and website use Analytics services provided by Google Analytics. Information collected from these services is entirely anonymous. Only general information is captured (For example, the type of browser or operating system you are using, screen resolution and which parts of the site you interact with). No form data is captured or read by these services. We use website recording services in order to improve our services’ usability and see how visitors interact with features and pages.

All customer data is handled sensitively by members of our team and physical access to our offices is restricted to authorized personnel only.

Radiolize reserves the right to make alterations to this document whenever we deem reasonable. It is the clients sole responsibility to check this document for updates on a regular basis.

What Are Your Rights?

If at any point you believe the information we process on you is incorrect you can request to see this information and even have it corrected or deleted.

Please be aware, in order to remove any of your data, this may prevent us from providing services to you and could result in the closure of your account.

We may use third-party Service Providers to monitor and analyze the use of our Service.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

Our Service does not address anyone under the age of 18 (“Children”).
